Controlled Substances (Amendment) Bill
1. The Controlled Substances Act, 1974, is amended by adding the following after section 45 thereof.
45.1. Any person who does sell or traffic any substance, drug, or narcotic included in Schedule I or II within five hundred metres of any school, preschool, daycare, or educational facility that has as its primary objective the education of students under the age of 18 shall be guilty of a felony and liable
- (a) for the first offence, to imprisonment for a term of twenty years and to a minimum punishment of imprisonment for a term of three years; and
- (b) for a subsequent offence, to imprisonment for life and to a minimum punishment of imprisonment for a term of eight years.
45.2. Any person who does sell or traffic any substance, drug, or narcotic included in Schedule III within five hundred metres of any school, preschool, daycare, or educational facility that has as its primary objective the education of students under the age of 18 shall be guilty of a felony and liable
- (a) for the first offence, to imprisonment for a term of not more than eight years and to a minimum punishment of imprisonment for one year; and
- (b) for a subsequent offence, to imprisonment for a term of not more than twenty years and to a minimum punishment of imprisonment for four years.
45.3. Any person who does sell or traffic any substance, drug, or narcotic included in Schedule IV within five hundred metres of any school, preschool, daycare, or educational facility that has as its primary objective the education of students under the age of 18 shall be guilty of an indictable offence and liable
- (a) for the first offence, to imprisonment for a term of not more than four years and to a minimum punishment of imprisonment for six months; and
- (b) for a subsequent offence, to imprisonment for a term of not more than ten years and to a minimum punishment of imprisonment for eighteen months.
Constitutional Amendment
Be it Resolved by the Senate and Commons in this Present Parliament Assembled:
The Governor-General shall be authorized to enact a proclamation amending the Constitution Act, 1955, as follows:
1. The Constitution Act, 1955, is amended by adding the following after section 39.1 thereof.
39.2. Section 39 of this act shall not be interpreted to overturn the lawful orders given to members of the militias, military forces, and naval forces of Ibagli.
